4. Overtime/Compensatory Time

Rivers v. Quirk (1984), 30 Ohio App.3d 35. R.C. 124.34 is the exclusive route of appeal of an order taking away a city policeman's compensatory time; a direct appeal to the court of common pleas under R.C. 2506.01 is not available.

Laughlin v. Ohio Dept. of Administrative Services (1988), 47 Ohio Misc.2d 1. R.C. 124.18 provides that no overtime can be paid unless it has been authorized by the authorized administrative authority; the authorized administrative authority for an employee of the department of commerce, division of the state fire marshal, is the director of the department of commerce.

Pursuant to O.A.C. 123:1-43-02 and the applicable provisions of the fair labor standards act, the appointing authority of each agency may designate positions, the duties of which are professional, administrative or executive in nature, as overtime exempt.
